Multi-state dealer groups selling in both Oregon and California need a clear, side-by-side view of what each state requires around title-brand checks and consumer disclosures — and where NMVTIS fits into your desk/F&I flow. Oregon’s 2025 bill (SB 840) adds new dealer record and disclosure duties that take effect January 1, 2026. This page is for general information only — not legal advice; consult counsel for compliance specifics.

What both states aim to prevent

Both Oregon and California require dealers to surface and disclose title brands, salvage/junk history and other adverse title indicators so consumers aren’t sold vehicles with hidden branding or safety issues. The NMVTIS report is the primary tool states use to create an audit trail and standardize brand information across jurisdictions.

The big differences at a glance

Below is a quick primer before the table: Oregon’s SB 840 (effective Jan 1, 2026) adds explicit dealer record/retention language that references an NMVTIS vehicle record report copy and disclosure duties; California has required NMVTIS reports for retail used vehicles since AB 1215 (effective July 1, 2012) and long-standing window/label posting and disclosure rules for branded/salvage entries.

Comparison Table

State Requirement Summary Timing & Disclosure Recordkeeping, Exceptions & Effective Date
Oregon (SB 840) SB 840 adds dealer duties to obtain and retain an NMVTIS vehicle record report and strengthens title-branding rules under Oregon DMV regulations. Dealers must rely on NMVTIS for brand info in some title decisions. Must be run before offering/displaying a used vehicle for sale where a title/brand issue may exist, and as required under new dealer recordkeeping rules. Disclosure required when title brand or salvage/junk indicators are present; dealer must make report available per rules. Dealers must retain a copy of the NMVTIS report (originals for current and prior year on site; 5-year retention for other records). Exceptions may exist for certain transfers or law enforcement/title issuance. Effective Jan 1, 2026. Notes: Oregon DMV rules (OAR) govern how NMVTIS data affects title branding.
California (AB 1215 / VC §11713.26) Licensed dealers must obtain an NMVTIS report from an approved provider before offering a used vehicle for retail sale. Red-sticker/window posting and disclosure rules apply when brands are present. Must be run before offering or displaying the vehicle for retail sale. If NMVTIS shows junk/salvage or branded title, disclosure is mandatory via window sticker/red sticker and report must be made available on request. Dealers must retain copies of NMVTIS reports and disclosure evidence per recordkeeping rules. Exceptions are limited (e.g., some salvage processing). Effective July 1, 2012. Notes: California requires specific red-sticker language; DMV guidance and V.C. §11713.26 control details.

Practical takeaways for multi-state stores

  1. Intake / vehicle acceptance (auction trade or consignment): Immediately run an NMVTIS-capable vehicle history check and flag any brands or salvage/junk indicators. (Run via VinAudit or an NMVTIS-approved provider).
  2. Prep / vehicle status check: If NMVTIS shows a brand, place a “do not display/sell” hold until the title is confirmed, and prep required disclosures/labels per the state where the vehicle will be sold.
  3. Desk / pre-offer step: Before listing or physically displaying the vehicle in a given state, confirm you’ve run the NMVTIS check required by that state (California: before display; Oregon: per SB 840 and OARs, retain a copy and disclose if branded).
  4. Customer handoff / deal jacket: Provide the NMVTIS report or make it available on request at or before sale; attach a printed copy (PDF) to the deal jacket and also save an electronic copy in your DMS.

Quick start with VinAudit

  2. Review & disclose: If report shows a brand or salvage/junk indicator, follow the state requirement (California: window posting + disclosure; Oregon: disclose per SB 840 and retain report). Provide the report to the buyer on request or as required by state law.
  3. Attach & store: Save the PDF to your DMS and attach to the deal jacket; keep the electronic copy per state retention guidance (Oregon dealer rules reference multi-year retention for records; CA dealer regs require similar recordkeeping).
